Subject: Important AWD Malfunction

So here I am the night before my p/x deal tomorrow and a much hoped for end to the worry and stress of the last 4+ weeks. Having been promised return of my repaired car from Wednesday onwards this week, at 4pm today we had to phone the garage for an update to be told that the second oil seal replacement had failed to fix the oil leak and that my car wouldn't be returned in time for me to honour the p/x deal I have agreed. The garage suggested taking the car without it being repaired but we couldn't believe what we were hearing.
The dealer with whom I have agreed my p/x, much to our amazement, agreed to take the car despite it still having the oil leak provided there are no warning or malfunction lights showing when they receive it.
I have said that I am not prepared to remove my car from the Ford garage knowing it to have a fault as liability for the car would then revert to me. If a warning light should come on whilst driving it to the other dealers premises I would be faced with them rejecting it as a p/x vehicle and with Ford saying that I had assumed all responsibility by taking it from their garage.
I imagine my insurance would also be invalidated if I was involved in an accident whilst driving a car I know to have a fault of undiagnosed origin.
What an absolute mess this is!!!!
